Pedi Clipper™ Two Year Limited Warranty

Practical Specialties, LLC ("PSL"), warrants the Pedi Clipper™  long handled toenail clipper against defects in materials and workmanship for a period of two (2) years from the original date of end user purchase.

This warranty shall not apply to defects or damage resulting from: unauthorized modification, misuse, abuse, improper installation, improper repair or improper maintenance. Because of state and local health department regulations in the State of Washington, toenail clippers are considered personal hygiene items and may only be returned for credit if in the original unopened packaging materials.

Your sole and exclusive remedy for a covered defect is repair or replacement of the defective product at PSL’s sole option and expense. If PSL is unable to replace a defective product, your alternative exclusive remedy shall be a refund of the original purchase price less applicable shipping and handling charges. The above is PSL’s entire obligation to you under this warranty. IN NO EVENT SHALL PSL BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OR LOSSES WHETHER BASED ON CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, INCLUDING LOSS OF USE OR PROFITS EVEN IF PSL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Some states do no allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

THE ABOVE WARRANTY IS EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO THIS PRODUCT.To the maximum extent permitted by applicable law, PSL SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTIES, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Any implied warranty required by applicable law shall be limited in duration to the express warranty term. Some states do not allow disclaimers of implied warranties or limitations on how long an implied warranty lasts, so the above limitation may not apply to you.

To obtain warranty service, products must be returned to PSL, provided that prior authorization is obtained by contacting PSL and requesting a return authorization ("RMA") number. In the event the return is authorized, you shall prepay all charges for shipping the products to the factory and PSL shall pay all shipping charges for the return of the products to you.

This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.
